Service Disclosure & Release of Liability

1. Marketing Intent & Artistic Licence

The Client acknowledges that all photography, videography, and 360° virtual tours provided by Troy Massey Media are intended for marketing and promotional purposes only.

Visual Representation: Images are captured using professional techniques (e.g., wide-angle lenses) which may alter the perceived scale or depth of spaces.
Digital Editing: Minor enhancements (lighting, sky replacement) are performed to provide a high-quality aesthetic but are not intended to hide material defects. The Client is responsible for ensuring the final imagery does not misrepresent the property under the Australian Consumer Law (misleading and deceptive conduct).

2. Floor Plan & Measurement Disclaimer

All floor plans are generated via digital scanning and/or AI-assisted software and are not professional surveys.

Approximations: All measurements, including room dimensions and total square meterage, are approximate and for illustrative purposes only.
Accuracy: Troy Massey Media does not warrant the mathematical accuracy of these plans. They must not be relied upon for legal, architectural, or construction purposes.
Queensland Seller Disclosure: The Client acknowledges that under the Property Law Act 2023 (Qld), the Seller has a statutory duty to provide accurate disclosure. Troy Massey Media is not a "prescribed certifier" and the floor plan or any other marketing media should not be treated as a definitive statement of the property's area.

3. Intellectual Property & Marketing Rights

Licence to Client: Troy Massey Media grants the Client and the listing Real Estate Agency permission to use the materials for the purpose of marketing the specified property.
Promotional Use: The Client expressly permits Troy Massey Media and/or the listing Real Estate Agency to use any of the materials for its own business promotion, portfolio, and social media.

4. Indemnity & Limitation of Liability

Indemnity: The Client agrees to indemnify and hold Troy Massey Media harmless against any claims, losses, or costs (including legal fees) arising from any inaccuracies, errors, or omissions in the materials, or for any claim of "misleading and deceptive conduct" by a third-party, buyer or tenant. The marketing materials provided are artistic creations for illustrative marketing purposes only. They are not for legal, architectural or construction purposes.

Provision of Materials: The Client warrants that they are the legal owner of, or have obtained all necessary absolute rights and licenses for, all materials provided to Troy Massey Media (including but not limited to images, plans, architectural renders, and data).

Right to Modify: The Client expressly grants Troy Massey Media the right to use, adapt, and transform these materials as a base for 3D rendering software and AI-generated video production for the purpose of marketing media recreation.

The Client agrees to indemnify and hold harmless Troy Massey Media against any claims, damages, or legal costs arising from third-party copyright infringement or ownership disputes regarding the provided materials.

By checking this box and submitting this form, I acknowledge that I have read and agree to the Client Disclosure, Marketing Agreement and Liability Release. I understand that all photography, videography, 360° tours, A.i content and floor plans are provided for marketing purposes only and contain approximate measurements and artistic representations. I hereby waive and release Troy Massey Media, its owners, contractors, and constituents from any and all liability, claims, or costs.
